Federal Judge Overturns Maine Prescription Drug Law

Judge Nancy Torresen of the U.S. District Court in Maine invalidated a two-year-old law which allowed residents to purchase prescription drugs from some foreign Internet pharmacies. The law, known as the Maine Pharmacy Act, was the first-in-the-nation to allow such purchases to legally occur. In Judge Torresen’s decision, she ruled that the law is superseded by federal legislation and that therefore the state did not have the right to enact the measure.
